looked inside type defs for any clues. layer="bottom" did the trick.

conveniently, discovered a separate bug as a result: here is an 0402 from kicad rotated 110 degrees, on the top surface. all looks correct. now, with layer="bottom" pic 3 with stock footprint="0402" similar issue. I think transforms are being applied incorrectly to pads when on bottom layer.

lastly, putting a component on layer="inner1" puts it on the top of the board, and no errors. ideally this should be a type error - components themselves like resistor, chip, etc... can only be placed on layers top or bottom ...unless you're TI and embedding silicon into substrate, which... we are not (yet)
