"Open Terminal here" issues

I'm having the oddest behavior around terminal
if I "open terminal here" on a folder the first time, it won't cd to that folder and stay at ~
but if I do it a second time it cd correctly
i.e "open terminal here" only works if there's already a terminal running

I'm not sure how I would start with troubleshooting this...
